The terms ‘Privacy Policy Statement’ and ‘Privacy Policy’ and ‘Privacy Statement’ and ‘Policy Statement’ and ‘Policy’ are used interchangeably here and unless otherwise stated each can be taken to mean this ‘Privacy Policy Statement’.

The terms ‘Data’ and ‘Information’ are used interchangeably in this context, and unless otherwise stated, the term ‘information’ used here is taken to mean any type of ‘personal information’ as defined under the GDPR. The terms ‘gather’ and ‘collect’ are used interchangeably in this context.

A Privacy Policy pertains to personal information about you that may be gathered by and kept by an entity in dealing with you. In this the term ‘personal information’ is as defined under the General Data Protection Regulation (or GDPR as it is known). This applies irrespective of the nature of such dealings or the means by which such dealings are conducted, whether that be in the form of a website, or by some other means, or any combination of such means. A privacy policy exists in the context of the requirements set out by the GDPR and serves to protect your rights regarding personal information that pertains to you that may be gathered by and kept by some other party. The Purpose of a Privacy Policy

In dealing with an entity, in whatever form, a privacy policy essentially lays out: what information may be collected about you during your dealings; how this information is collected; what use may be made of it, which in turn relates to why it is collected; how it is protected; how it is controlled/managed; how you may request details regarding what information may be kept about you; and how you may instigate changes to such information, including requesting the removal of such information from whatever records may be held. In addition, the ‘legal basis’ for collecting such information must be stated, in-line with the valid bases as defined under the GDPR.

Irrespective of the source of such information, or the means of communication, or even when such information may be gathered, or the exact circumstance of gathering it, what is most important is the actual personal information itself. And following this, how such information is managed. To this end, this Privacy Policy acts to fulfil the purpose of a privacy policy as noted above, all with the intent that you are clear regarding the personal information that may be held about you, and how this information may be used. Overall, you should feel that things are reasonably clear and transparent regarding information that may be gathered about you and the basis upon which such information is gathered.

 

 

In The Context of This Website

To be clear, this website does not gather any personal information about a site visitor, other than what may be construed as personal information as per the Cookies used, in turn, to support and enable an operational website. Please read the Site Cookies Notice. In essence this website simply presents content for information purposes only, subject to the Site Disclaimer and Site Copyright Notice. If this operational position and policy changes then this Privacy Policy will change commensurately.

B: THE PURPOSE OF THE INFORMATION PROCESSING

Information gathered may be used to help in the general operation of this website including understanding the nature of the site usage, and in responding to any enquiries that may otherwise stem from any contact you may choose to make with the site owner.

C: THE LAWFUL BASIS UPON WHICH THIS INFORMATION IS PROCESSED

Any personal information that may be gathered and used by us is gathered and used under the basis of ‘Legitimate Interests’ (as per the GDPR definition).

In particular, other than typical Cookie related information, any such information that may be gathered by us essentially boils down to any contact details that you may choose to provide including but not limited to an email address, and any comments you may choose to offer that form the basis of your communication with us, all in the context of you making an enquiry with us and us responding to your enquiry. Such information is in essence volunteered by you or freely given upon request. For example, in the context of responding to any enquiry, the ensuing communication between us may itself result in further information being captured that may be deemed ‘personal information’, but in any case, any such information if applicable, would tend to be freely given by the person making the enquiry. In essence, we could not respond to an enquiry without being able to gather and process a certain minimum necessary set of information, as outlined under D: below.

D: THE PERSONAL INFORMATION THAT MAY BE GATHERED

In general any one or more of the following types of information may be gathered:

  • your contact information including your: email address; telephone number; and your physical address if pertinent

  • the means by which the information may be acquired

  • whatever information you may otherwise choose to provide that forms the basis of your enquiry and interaction with us

 

If during the course of any interaction it transpires some information additional to that noted above is required and which is deemed personal information, then it will only be gathered with your explicit consent.

 

NOTE Privacy Policy is something that applies only with respect to ‘personal information’, as defined under the GDPR. Any other information is outside the scope of the GDPR.

E: THE SOURCE OF THE INFORMATION THAT MAY BE GATHERED

In general the source of the information about a given individual will be the individual themselves, and acquired as noted under F: below.

F: HOW YOUR PERSONAL INFORMATION MAY BE ACQUIRED

This closely relates to E: above. The information that may be acquired by us is primarily by virtue of any communication we may have between us following an initial communication sent by you and received by us, which would be via the contact details given above; and possibly through any other typical form of communication that may otherwise ensue or arise following an initial contact, including for example, via further email communication or via a telephone conversation between us via a land line or mobile network during which notes may be captured by an appropriate means.

G: WHO MAY PROCESS (USE) THIS INFORMATION

All personal information noted here is used only by myself. The principal exception to this would be if I were obliged through law to share this information with some authority, and similarly, if by the nature of our communication it was necessary to involve a third party as noted under H: below.

Your personal information will not be sold, shared, distributed or leased to any third party whatsoever. Such information will only be provided to a third party if required by law to do so or to a third party if in the context of helping respond to your enquiry.

We are committed to ensuring that any information acquired is kept secure. In order to prevent unauthorized access or disclosure of such information, we have in place reasonable, suitable physical, electronic and managerial procedures to safeguard and secure the information collected.

CONTROLING YOUR PERSONAL INFORMATION

As noted under H: above, your personal information will not be sold, shared, distributed or leased to any third party. Such information will only be provided to a third party if required by law to do so, or if necessary to do so in the context of engaging a third party to help in responding to your enquiry.

We will use the contact details which you have provided. In doing this we recognize that such details may change and any such changes will be appropriately managed if we become (or are made)  aware of them.

J: THE RETENTION PERIOD APPLIED TO YOUR PERSONAL INFORMATION

Any information that may be gathered may be retained for up to 12 months, after which time it will be destroyed unless there has otherwise been any subsequent follow-up communication and dealing between us, in which case we may need to retain such information for the duration of any ongoing relationship we have and for no more than 12 months from the end of such a relationship. The main exception to this would be if for any legal or related purposes such information was needed to be retained for longer, in which case this longer retention period would be made clear.

K: YOUR RIGHTS RELATED TO ALL OF THIS

Under the GDPR, and indeed by virtue of our own operating principles, you may freely request:

Details of any personal information which may be held about you. If you would like a copy of the information that may be held please contact me via the contact details provided under A: above.

Similarly, if you believe that any personal information being held about you is incorrect or incomplete please contact me as soon as possible and the situation will be rectified.

And if you would like me to remove from my system any personal information about you then please contact me to do so. The only practical consideration here is the extent to which a lack of basic contact information may induce a genuine problem regarding such things as awareness of previous dealings between us and the like.

 

Notwithstanding the above points, any information about an individual that we may possibly hold will only have come into existence with us by virtue of the given individual initiating an enquiry with us and providing such information to us, and which may otherwise be gathered during the course of responding to any such enquiry.
